- For this Rental Agreement, the term service includes the delivery, placement, setting, use, pick up, relocation, service, dump, or retrieval of the dumpster.
- For this Rental Agreement, the term property includes yards, landscaping, sidewalks, driveways, roads, culverts, fences, sprinkler systems, grass, trees, bushes, patios, soffits, gutters, or other surfaces that the vehicle or equipment may contact while attempting to service dumpster.
- Customer hereby understands and agrees that they have custody and care of the dumpster owned by Black Hawk Waste Disposal and accept responsibility for said dumpster and its contents while on the service property.
- Customer acknowledges that the trucks and related equipment used by Black Hawk Waste Disposal are heavy in weight and may cause damage to property on which those trucks or equipment travel.
- Customer agrees to indemnify, defend, and hold Black Hawk Waste Disposal harmless from any damages to the property or injury to persons that may arise from customer’s use, or possession of the dumpster(s) and from any service of the dumpster(s).
- Customer understands that any loss/damages to dumpster(s) left on the service property is their responsibility.
- It is the customer’s responsibility to maintain and care for the dumpster(s) while on their property.
- Customer will be liable to pay for damages due to neglect, overloading, misuse, fire, or other unforeseen causes.
- Black Hawk Waste Disposal shall not be held liable for failure to perform services due to circumstances beyond a reasonable control including, but not limited to strikes, riots, fires, wind, inclement weather, or acts of God.
- Customer understands that the following items are not accepted in the dumpster. If found in the dumpster, customer will be charged extra fees based on material.
- Animal Products – Animal Manure, Dead Animals
- Tires – Tires found in the dumpster are charged at a rate of $60.00 each.
- Appliances – Stoves, Dehumidifiers, Microwaves, Washers, Dryers, Fluorescent Light Fixtures or Fluorescent Bulbs
- Appliances found in the dumpster are charged at a rate of $75.00 each.
- Liquids – Paint, Thinner, Gas, Diesel, Oil, Solvents, Chemicals
- Hazardous Materials – Medical Waste, Radioactive Waste, Flammable Waste, Corrosive Waste, Toxic Waste, Bio-Hazardous Waste, Explosive Waste, Pesticides, Herbicides, Acid, Poison, Asbestos, Batteries
- Adhesives – Glue, Epoxy, Paint, Resin
- Customer Understands that the following items need prior authorization, and if found in the dumpster, extra charges will apply.
- Nature Products – Yard Waste, Trees, Shrubs, Branches, Grass, Sticks, Leaves, Trimmings
- Construction Debris – Concrete, Sand, Gravel, Rock, Dirt, Brick
- The above listed items are not a complete list of restricted items. We have listed the most common restricted items.
- The container must not be loaded beyond capacity.
- Nothing may be put in a container that will prevent items from falling out when emptied.
- No contents may be above the top of the dumpster. Any contents above the top of the container will result in additional fees or be denied service until leveled. Return trip charges will apply.
- All containers with lids must be closeable upon servicing. Open lids or overflowing trash may result in refuse spillage. Refuse spillage due to over-full is the customer’s responsibility to prevent and cleanup.
- Our drivers must be able to tarp temporary dumpsters for safe transportation.
- Clear access to the containers is the responsibility of the customer.
- Return trips due to blocked containers, obstructed access, or the inability to service a container may result in a return trip fee.
- To ensure collection, containers must be accessible and available prior to 5:00 A.M. on your designated collection day. This includes gates open, locks removed, vehicles moved from collection area, no objects blocking the containers, and snow/ice clear from in front of containers.
- The driver is not required to wait any length of time for the customer to clear access to the container, nor are they required to find someone onsite if this container is blocked. Containers must be clear prior to 5:00 A.M. on your designated collection day.
- It is the customer’s responsibility to keep the area surrounding a dumpster free of debris, trash, cardboard, large items, snow, ice, and other obstacles that would hinder pickup.
- Large item collection is available in most areas. Please contact us at (319)232-4150 to schedule a large item pickup. Our drivers will not collect large items from around the dumpster without prior authorization.
- Temporary dumpster daily rental rates are $5 per day that begin on the 8th day after the dumpster is delivered.
- We do not automatically remove the dumpster. Please contact our office to make arrangements for removal.
- Dumpsters over the legal hauling limit of 20,000 lbs are subject to an overweight fee of $70 per ton after 20,000 lbs. Extremely overweight dumpsters are subject to further fees after 30,000 lbs including but not limited to an additional haul charge.
- Black Hawk Waste Disposal reserve the right to refuse service for containers that cannot be safely transported, or safely accessed.
- This agreement shall be binding on the successors, assigns, heirs, administrators, and executors of the customer and shall apply to any containers rented by the customer.
By ordering a roll off dumpster with Black Hawk Waste Disposal, customer agrees they have read and understand the information listed in this notice and agree to comply with these rules and guidelines. |
